Legal Agreements & Data Authorization

By submitting your vehicle request through First Nation Approval, you acknowledge and agree to the following:

1. Information Sharing Authorization

You authorize First Nation Approval to share your submitted information with:

  • Licensed automotive dealerships
  • Financial institutions
  • Lending partners
  • Credit reporting agencies
  • Third-party service providers involved in processing your request

This sharing is necessary to evaluate your eligibility and secure vehicle financing or approval options on your behalf.

2. Credit & Verification Authorization

By submitting your request — and, to the maximum extent permitted by applicable Canadian law, simply by accessing or using this website — you expressly and voluntarily authorize First Nation Approval and its participating dealerships, lenders, and financial partners (collectively, the "Authorized Parties") to do the following for the purpose of evaluating your vehicle financing eligibility:

  • Obtain, review, and verify your credit profile and credit report from one or more consumer reporting agencies (including Equifax Canada Co. and TransUnion of Canada);
  • Verify your employment status, employer, job title, length of employment, and income (including through pay stubs, bank statements, and notices of assessment);
  • Conduct identity and fraud-prevention verification against provincial and federal databases, driver's licence, motor vehicle, and government-issued identification records, to the extent permitted by law;
  • Perform soft credit inquiries (which do not affect your credit score) for pre-qualification and rate-estimation purposes; and
  • Perform hard credit inquiries (which may appear on your credit file and temporarily affect your credit score) as required by lender underwriting guidelines to complete your financing application.

This authorization is required to determine financing eligibility and is given voluntarily. Where a lender's guidelines require it, the Authorized Parties are permitted to obtain both a soft pull (for pre-qualification) and a subsequent hard pull (for formal credit adjudication) on the same file, and you consent to both. This authorization remains valid from the time you access or submit through this site until your financing is completed, your application expires or is withdrawn, or you withdraw consent in writing. A copy of this authorization may be relied upon by participating lenders as your written consent to pull a full credit report.

Your consent is provided in accordance with, and the Authorized Parties' use of your credit information is limited by, applicable Canadian law, including the Personal Information Protection and Electronic Documents Act (PIPEDA, S.C. 2000, c. 5), the Consumer Reporting Act (British Columbia: RSBC 1996, c. 75), the Consumer Reporting Act (Alberta: RSA 2000, c. C-23), and the corresponding consumer-reporting and privacy legislation of each province and territory where you reside or apply. For residents of Quebec, this authorization is also provided in accordance with Quebec's Act respecting the protection of personal information in the private sector (CQLR c. P-39.6, as amended by Law 25) and the Charter of the French language (CQLR c. C-11), which require that consent be clear, specific, freely given, and informed. Where Quebec leads are captured, consent is collected on the same explicit clickwrap basis described below and a French version of this authorization, together with French privacy practices, is available on request to info@firstnationapproval.ca. You have the right to access, correct, or request the source of your credit information and may withdraw this consent in writing at any time, subject to the obligations of lenders who have already relied on it.

Nothing in this section limits any other right or authorization available to the Authorized Parties under applicable Canadian federal or provincial law. If any provision is found unenforceable, the remainder continues in full force and effect.

How Your Consent Is Captured at Submission (Clickwrap)

For the specific, sensitive act of pulling your credit file — which may affect your credit score — we do not rely on "browse-wrap" (passive consent from merely visiting this site). Instead, at the moment you submit your application the form requires an affirmative, unambiguous clickwrap act: a consent checkbox that is never pre-checked, is displayed immediately above the submit button, and displays text reading (or substantially reading) "I authorize First Nation Approval and its lending and dealership partners to obtain my credit report, including soft and hard inquiries, to evaluate my financing eligibility." That box must be actively checked by you for the submission to proceed. No credit inquiry is requested, and no consent is inferred, from your presence on the site, scrolling, navigation, or passive browsing alone — only from that active click tied to that specific submission.

This means the authorization on this page is layered: the general terms above describe what you are authorizing, and the checkbox on the form captures your binding consent to that authorization at the precise moment of submission. If you do not check the box, your application is not submitted and no credit pull occurs.

Audit Trail of Your Consent

To make your consent verifiable and defensible — and to satisfy lender and credit-bureau audit requirements — at the moment you submit we create and securely retain a consent record tied to that specific application. The record includes, at minimum: the exact consent statement text displayed to you at that submission, your name and contact details, the date and time (timestamp, UTC) of your consent, your IP address, your browser user agent, the unique application or session identifier the consent is bound to, and the version of these Legal Agreements in effect at that time. This record is retained as evidence of your affirmative clickwrap consent and is available to you and to participating lenders upon request.

Adverse Action & Your Right to Your Credit Report

If a participating lender uses information from your credit file in whole or in part to decline your application, offer less-favourable terms, or take any adverse action, you have the right to be informed, and — to the extent required by the applicable provincial consumer-reporting statute and PIPEDA — to obtain a copy of the report relied upon and a statement of the reasons, directly from the consumer reporting agency that supplied the report (e.g., Equifax Canada or TransUnion of Canada). If you are declined or offered adverse terms and wish to exercise this right, contact us at info@firstnationapproval.ca and, where required by law, we will provide (or direct you to) the name and address of the reporting agency and the steps to obtain your report so you may verify its accuracy and dispute any incorrect information before it is used again.

You also retain the broader rights available to you under PIPEDA and provincial consumer-protection statutes to access, correct, and request the source of personal and credit information held about you, and to withdraw this consent in writing at any time — subject to the lawful obligations of lenders who have already relied on your consent.

3. Communication Consent

You agree that First Nation Approval and its partners may contact you regarding your vehicle request via:

  • Phone calls
  • SMS messages
  • Email communications

You understand that multiple partner dealerships or lenders may contact you to assist with completing your vehicle approval or offer.

Message and data rates may apply. You may opt out of SMS by replying STOP.

4. No Guarantee of Approval

Submitting your information does not guarantee:

  • Loan approval
  • Specific interest rates
  • Vehicle availability
  • Bonus eligibility

Final decisions are made by third-party lenders and dealerships.

5. Purpose of Data Use

Your information is used solely for:

  • Vehicle financing evaluation
  • Matching you with vehicle options
  • Structuring payment programs
  • Processing approval requests

We do not sell your personal information to unrelated third parties.

6. Acceptance by Visiting the Site (Browse-Wrap Consent)

By accessing, browsing, or using this website in any way — whether or not you submit an application — you acknowledge that you have read, understood, and agree to be bound by these Legal Agreements, our Privacy Policy, and our Terms & Conditions, as amended from time to time. Your continued use of the site constitutes your acceptance of these agreements.

To the maximum extent permitted by applicable Canadian law, by visiting or using this site you agree that First Nation Approval, its officers, directors, employees, agents, affiliates, participating dealerships, lenders, and financial partners shall not be liable to you for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or financing opportunities, arising out of or relating to your use of the site, your submission of information, or the credit inquiries and disclosures authorized above — whether based on contract, tort (including negligence), statute, or any other legal theory — even if First Nation Approval has been advised of the possibility of such damages.

To the extent permitted by applicable Canadian provincial consumer-protection and privacy legislation, you agree to release and hold the Authorized Parties harmless from any claims, demands, causes of action, or liability arising out of the credit inquiries (soft or hard), verification of employment and income, and information sharing authorized in this Agreement. Nothing in this section excludes or limits any liability or consumer right that cannot be excluded or limited under Canadian law (including rights under PIPEDA and provincial consumer-protection statutes).

You agree that, to the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to this site, your use of it, or the credit and information authorizations above shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, and you attorn to the exclusive jurisdiction of the courts of British Columbia, except where a provincial consumer-protection statute requires otherwise.

7. Acknowledgment

By proceeding with your submission and accepting the site's consent checkbox, you confirm that:

  • The information provided is accurate
  • You authorize the sharing and review of your information, including the soft and hard credit inquiries described above
  • You have read and agree to be bound by these Legal Agreements, the Privacy Policy, and the Terms & Conditions by virtue of both submitting and simply by visiting this site
  • You understand lenders or dealerships may contact you directly
  • To the maximum extent permitted by Canadian law, you waive any right to sue or hold the Authorized Parties liable for the consequences of the authorized credit inquiries and information sharing
